1. Introduction

Daycheck ("we", "our" or "the app") respects your privacy and is committed to protecting your personal data. This policy explains how we collect, use, share, and protect your information, including when your data is sent to third-party artificial intelligence services.

2. Data We Collect

We collect the following types of data:

• Account data: Email, name, and profile picture to create and manage your account
• Task data: Tasks, schedules, categories, and evidence you create
• Images: Photos sent as evidence of completed tasks (camera/gallery)
• Audio: Voice recordings sent to the chat assistant (processed and not permanently stored)
• Location: For running/walking features (only when authorized)
• Health data: Optional information such as weight, height, gender, medical exams, and health documents you provide
• Usage data: App interactions, chat history with the AI assistant
• Purchase data: Subscription and transaction information (processed by Apple App Store and Google Play)

3. How We Use Your Data

• Manage your tasks and daily routine
• Validate task evidence with artificial intelligence
• Provide personalized responses through the AI chat assistant
• Create personalized meal plans based on your health data
• Send notifications about your tasks
• Process in-app subscriptions and purchases
• Generate personal progress statistics

4. Use of Artificial Intelligence and Third-Party Data Sharing

4.1 AI Service Used

We use the Google Gemini API, provided by Google LLC, to process data in the chat assistant, task validation, and diet creation.

4.2 Data Sent to Google Gemini

The following data may be sent to the AI service, depending on the feature used:

• Text messages: Messages typed in the chat assistant
• Audio recordings: Audio recorded in the chat, converted to text and sent for processing
• Task photos: Images sent for evidence validation
• Health data: Weight, height, gender, medical exams, and health documents, when used for diet creation or personalized responses
• Conversation history: Previous messages from the chat session to maintain context

4.3 Data Recipient

Data is sent to: Google LLC (Mountain View, California, USA), through the Google Gemini API. Processing is governed by the Google AI API Terms and the Google Privacy Policy.

4.4 Purpose of Data Sharing

• Generate personalized responses in the chat assistant
• Validate photographic evidence of completed tasks
• Create personalized meal plans
• Answer questions about health and well-being based on provided data

4.5 Consent

The first time you open the chat assistant, the app will display a detailed notice explaining what data will be sent, to whom, and for what purpose. You must agree before any data is sent. If you do not agree, the AI assistant will not be activated and no data will be shared with Google Gemini.

4.6 Data Protection

Data is transmitted via HTTPS (encryption in transit). According to the Google Gemini API terms for developers, data sent via the API is not used by Google to train its AI models.

5. Camera Usage

The app requests permission to access your camera to:

• Take photos as evidence of task completion
• Upload images from your gallery for AI validation
• Update your profile picture

Evidence images may be sent to Google Gemini for automatic validation (see section 4).

6. Microphone Usage

The app requests permission to access your microphone to:

• Record voice messages in the chat assistant

Audio recordings are converted to text and sent to Google Gemini for processing. Audio recordings are not permanently stored on our servers.

7. Location Data Usage

The app requests permission to access your location for:

• Running/walking tracking: Monitor distance, speed, and route during physical activities
• Progress maps: Display your route on a map during and after the activity
• Exercise task validation: Confirm that physical activity was performed

Important:

• Location is only collected when you start a running/walking activity
• You can disable location permission at any time in your device settings
• Location data is stored securely and is not shared with third parties
• We use Mapbox to display maps, subject to the Mapbox Privacy Policy

8. Storage and Security

Your data is stored on secure servers (Supabase) with encryption at rest and in transit. Evidence and profile images are stored via BunnyCDN. We use industry-standard practices to protect your information.

9. Third-Party Data Sharing

We do not sell your personal data. We share data only with the following providers, which offer equivalent or superior protection:

• Google LLC (Gemini API): Messages, audio, photos, and health data for AI processing (see section 4)
• Supabase Inc.: Data hosting and storage
• BunnyCDN (BunnyWay d.o.o.): Image storage and delivery
• Mapbox Inc.: Map display for running activities
• Apple Inc. / Google LLC: Subscription payment processing
• When required by law: In compliance with legal obligations

10. Your Rights

You can:

• Access your personal data within the app
• Request correction of incorrect data
• Delete your account and all data directly in the app
• Revoke permissions (camera, microphone, location, notifications) at any time
• Decline the use of the AI assistant (by not providing consent)

11. Account and Data Deletion

You can delete your account and all associated data directly in the app:

• Go to your Profile → tap the Settings icon (⚙️) → Delete account
• Confirm deletion through two security steps

Deletion is permanent and immediate. All your data will be erased, including: profile, tasks, evidence, conversations, health data, friendships, and subscriptions.

Alternatively, you can request deletion by email at suporte@iahub.me. In this case, deletion will be processed within 30 days.

12. Optional Data

The following data is optional and never required to use the app:

• Gender
• Weight, height, and health data
• Medical exams and health documents
• Profile picture

This data is only requested to enhance features such as health calculations and personalized diets. You can skip these steps and use the app normally.

13. Changes to This Policy

We may update this policy periodically. We will notify you of significant changes through the app.

1. Acceptance of Terms

By downloading, installing, or using Daycheck ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Service Description

Daycheck is a task and habit management app with health features, an AI assistant, social networking, and gamification. The app allows you to create tasks, track habits, record health data, interact with an AI assistant, and connect with other users.

3. User Account

• You are responsible for maintaining the security of your account
• You must provide truthful information when creating your account
• You can delete your account at any time directly in the app (Profile → Settings → Delete account)
• Users under 13 years old should not use the app without parental consent

4. Subscriptions and Payments

4.1 Available Plans

• Daycheck Free: Basic access with up to 8 tasks per day
• Daycheck Premium Monthly: Auto-renewable monthly subscription
• Daycheck Premium Yearly: Auto-renewable yearly subscription

4.2 Subscription Terms

• Payment is processed by the Apple App Store or Google Play Store, depending on the platform
• The subscription automatically renews at the end of each period, unless cancelled at least 24 hours before the end of the current period
• Cancellation can be done through App Store or Google Play Store settings
• No refunds for partial periods already charged
• Prices may vary by region and are subject to change with prior notice

5. AI Assistant Usage

• The AI assistant is provided "as is" and may contain inaccuracies
• AI assistant responses do not constitute medical, nutritional, or professional advice
• Diets and meal plans generated by AI are suggestions and should be validated by healthcare professionals
• You are responsible for verifying information before acting on it
• Use of the AI assistant is subject to your explicit consent (see section 4 of the Privacy Policy)

6. User Content

• You retain ownership of the content you create in the app
• By making your profile public, you authorize other users to view your tasks and progress
• You must not publish illegal, offensive content or content that violates third-party rights
• We reserve the right to remove content that violates these terms

7. Limitation of Liability

• Daycheck is provided "as is", without guarantees of uninterrupted availability
• We are not responsible for decisions made based on AI assistant responses
• We are not responsible for data loss caused by failures beyond our control
• Our maximum liability is limited to the amount paid by the user in the last 12 months

8. Intellectual Property

Daycheck, including its design, code, brand, and original content, is the property of its developers. You may not copy, modify, distribute, or create derivative works from the app.

9. Termination

We may suspend or terminate your account if you violate these terms. You can terminate your account at any time by deleting it in the app settings.

10. Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. For Apple App Store users, the Apple Standard EULA also applies.

11. Changes to Terms

We may update these terms periodically. Continued use of the app after changes constitutes acceptance of the new terms.
